Interim / Terminal Schedule of Dilapidations, Pontefract

Client: Commercial Landlord

Another building where the Landlord was concerned with ongoing deterioration of the premises demised to the tenant.  Rowley Szilagy were appointed to advise on the available recourse under the terms of the lease.  A strategy was agreed and an interim Schedule of dilapidations was prepared for the Landlord to serve on the Tenant with a Repairs Notice.

The building remained unoccupied and the Repairs Notice focussed the tenant on their repairing obligations.  This lead to initial negotiations and revision of the Interim Schedule to an early Terminal Schedule of dilapidations accounting for reinstatement and internal redecoration of the premises as well as the disrepair.  The overall outcome was a successfully negotiated and recovered settlement for damages.
