Interim Schedule of Dilapidations, Chester
The Landlord was concerned with ongoing deterioration of the premises demised to the tenant and Rowley Szilagy were appointed to advise the Landlord as to the available recourse under the terms of the lease. A strategy was agreed and an interim Schedule of dilapidations was prepared for the Landlord to serve on the Tenant with a Repairs Notice.
After assessment of the lease documents and collation and examination of any other relevant documentation a full site survey was undertaken to determine the breaches of repair and decoration covenants contained within the lease. The service of the repairs notice lead to negotiation of surrender of the lease and a claim for damages was settled in favour of the Landlord.
